Brazil\u2019s Indigenous Affairs Agency, Funai, renewed the precautionary measure in <a href=\"https:\/\/www.documentcloud.org\/documents\/28589917-10078495820264013903-2281745731-decisao\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">2025<\/a>.<\/p>\n<p>The first reported invasions occurred a day after Par\u00e1 published the <a href=\"https:\/\/www.documentcloud.org\/documents\/28589916-lei-estadual-no-116652026\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">new state law<\/a> in the Official Gazette on August 12, 2026, announcing the creation of the <a href=\"https:\/\/www.documentcloud.org\/documents\/28589916-lei-estadual-no-116652026\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">APA Bacaja\u00ed<\/a> in the municipalities of Altamira and Senador Jos\u00e9 Porf\u00edrio. The APA covers about 142,400 hectares (351,880 acres) of land in the Brazilian Amazon, which <a href=\"https:\/\/www.documentcloud.org\/documents\/28589917-10078495820264013903-2281745731-decisao\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">overlaps<\/a> \u201c100% with the Ituna\/Itat\u00e1 Indigenous Land\u201d. The bill, which was <a href=\"https:\/\/alepa.pa.gov.br\/Legislativo\/DetalhesProposicao?IdProposicao=16099&amp;decisao=-1&amp;situacao=0&amp;veto=-1&amp;utm\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">introduced<\/a> in June by Par\u00e1 state representative (state deputy) Francisco Torres de Paula Filho, also known as Torrinho Torres, was unanimously approved and made law one month later.<\/p>\n<p>\u201cWhat was on August 13th limited to indications of opening access routes and destruction of territorial control structures, on August 16th, became an established occupation, with a significant concentration of people and the demarcation of plots within an interdicted Indigenous territory,\u201d the Public Defender\u2019s Office (DPU) stated in an <a href=\"https:\/\/www.documentcloud.org\/documents\/28589918-sei-9239453-oficio\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">official letter<\/a>.<\/p>\n<figure id=\"attachment_318690\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-318690\" src=\"https:\/\/imgs.mongabay.com\/wp-content\/uploads\/sites\/20\/2026\/05\/04162414\/Ituna_Itata-2-768x512.jpg\" alt=\"Cattle walk along an illegally burnt deforested area near Novo Progresso, in the northern Brazilian state of Para. Image by AP Photo \/ Andre Penner.<\/figcaption><\/figure>\n<p>An August 21 Instagram <a href=\"https:\/\/www.instagram.com\/p\/DcTGNx8gkCI\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">post<\/a> by Leonaldo Albuquerque, mayor of Senador Jos\u00e9 Porf\u00edrio municipality in Par\u00e1, shows a large crowd gathered around a barbecue and fireworks to celebrate what Albuquerque hailed as a new chapter.<\/p>\n<p>\u201cItuna\u2011Itat\u00e1 is in the past. Now this is the Promised Land,\u201d he wrote in the post.<\/p>\n<p>In the video, local politicians and newcomers stand at the edge of the federally protected Ituna\/Itat\u00e1 speaking of plans to establish cattle ranches and other agricultural activities.<\/p>\n<h2>APA sparks a land rush<\/h2>\n<p>In <a href=\"https:\/\/www.documentcloud.org\/documents\/28589918-sei-9239453-oficio\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">official letters<\/a> and <a href=\"https:\/\/www.mpf.mp.br\/o-mpf\/unidades\/pr-pa\/noticias\/forca-nacional-ituna-itata\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">public statements<\/a>, the DPU and the federal public prosecutor\u2019s office (MPF) linked the latest invasions to the state law published days earlier. After Torrinho <a href=\"https:\/\/www.instagram.com\/reel\/Db7B63jsFDB\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">announced<\/a> the creation of the APA Bacaja\u00ed on Instagram on August 11, about 200 armed invaders broke through Funai gates, removed signs and established camps, according to the <a href=\"https:\/\/www.mpf.mp.br\/o-mpf\/unidades\/pr-pa\/noticias\/forca-nacional-ituna-itata\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">MPF<\/a>.<\/p>\n<p>A spokesperson for Funai told Mongabay via email that during territorial monitoring and protection operations, the agents faced multiple \u201csituations\u201d that hindered the work of their teams and the performance of inspection and access control activities.<\/p>\n<p>\u201cThe absence of a rapid response would annihilate the rights of these groups, who depend on total isolation to avoid being exterminated by conflict or disease,\u201d the MPF <a href=\"https:\/\/www.mpf.mp.br\/o-mpf\/unidades\/pr-pa\/noticias\/forca-nacional-ituna-itata\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">stated in a lawsuit<\/a> filed on August 17, 2026, requesting the immediate deployment of the National Force and the Federal Police to Ituna\/Itat\u00e1.<\/p>\n<p>By August 24, the number of settlers had swelled to around 500 people, according to Helena Palmquist, deputy coordinator of the Observatory of Isolated and Recently Contacted Indigenous Peoples (OPI), who has been monitoring the situation via satellite imagery and field reports.<\/p>\n<p>\u201cIn the many years of following this type of activity here in Par\u00e1, in the Amazon, I have rarely seen a situation escalate so rapidly,\u201d Palmquist told Mongabay.<\/p>\n<p>For over a decade, Ituna\/Itat\u00e1 has suffered systematic illegal invasions, losing around <a href=\"https:\/\/news.mongabay.com\/2026\/05\/despite-restrictions-forest-loss-continues-on-ituna-land-home-to-isolated-people\/\" data-wpel-link=\"internal\">20,000 hectares (49,420 acres) of primary forest<\/a>. It was Brazil\u2019s <a href=\"https:\/\/news.mongabay.com\/2019\/10\/indigenous-communities-robbed-as-land-grabbers-lay-waste-to-brazilian-rainforest\/\" data-wpel-link=\"internal\">most deforested<\/a> Indigenous Land in 2019 but <a href=\"https:\/\/www.gov.br\/funai\/pt-br\/assuntos\/noticias\/2023\/funai-deflagra-operacao-eraha-tapiro-na-terra-indigena-ituna-itata\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">federal operations<\/a> to remove invaders in recent years improved the situation. Previous <a href=\"https:\/\/www.greenpeace.org\/brasil\/ituna-itata-uma-terra-indigena-da-amazonia-tomada-por-ganancia-e-destruicao\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">investigations<\/a> reveal that cattle raised illegally within the land are laundered through fraudulent permits and sold directly to major slaughterhouses like JBS, Marfrig and Frigol.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-318693\" src=\"https:\/\/news.mongabay.com\/wp-content\/uploads\/sites\/20\/2026\/05\/2026_034_AA_Ituna_Brazil_GIF_v2.gif\" alt=\"\" width=\"1350\" height=\"1080\"\/><\/p>\n<p>While an APA sounds positive on paper, it is legally weaker than a Funai restricted area, Fel\u00edcio Pontes J\u00fanior, a regional prosecutor with the MPF, told Mongabay by phone. In an APA, private landowners can still build homes and raise livestock.<\/p>\n<p>A spokesperson at the Ministry of Indigenous Peoples (MPI) told Mongabay via email that \u201cthe establishment of the APA, coupled with the provision for mechanisms to regularize non-Indigenous occupations, raises concerns, as it may create expectations of recognition of irregular occupations, encourage new invasions, and amplify conflicts and territorial pressures.\u201d<\/p>\n<p>Pontes, who brought the <a href=\"https:\/\/www.mpf.mp.br\/o-mpf\/unidades\/pr-pa\/noticias\/forca-nacional-ituna-itata\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">recent urgent appeal<\/a> before the federal court, said that the creation of APA Bacaja\u00ed was a \u201ccalculated strategy\u201d devised to create legal confusion that could then be exploited by people seeking to justify their entry and occupation of Ituna\/Itat\u00e1. According to Pontes, this is a recurring pattern during election periods, when political and legal uncertainty can be used to encourage land occupations and improve the electoral success of political figures.<\/p>\n<p>\u201cThere\u2019s always a group that uses its campaign to claim that the Indigenous areas of the Xingu region, or the Madeira region, or the Amazon, will no longer be Indigenous areas,\u201d he said. \u201cThis is impossible because it would require changing the federal Constitution. It\u2019s a lie, but they also use this lie as the basis for their election campaign.\u201d<\/p>\n<p>Supporters of the creation of APA Bacajai \u2014 among them state deputy Torrinho Torres, the author of the bill that became law \u2014 argue that smallholder farmers have campaigned for years for access to land and that the measure recognizes their rightful claims.<\/p>\n<p>However, <a href=\"https:\/\/www.nytimes.com\/2022\/03\/16\/magazine\/amazon-rainforest-ituna-itata.html\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">available documentary evidence<\/a> indicates that a significant proportion of actors in Ituna\/Itat\u00e1 operate as intermediaries in speculative land\u2011grabbing operations and associated illicit enterprises, including fraud, illegal deforestation and organized land speculation.<\/p>\n<p>Torrinho Torres, a cattle rancher who is running for re\u2011election in the current state electoral cycle, <a href=\"https:\/\/www.instagram.com\/reel\/Db7B63jsFDB\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">has framed the policy as a victory<\/a> for family agriculture. Mongabay sought comment from state deputy Torrinho Torres on these findings. At the time of publication, he had not responded.<\/p>\n<p>Experts have flagged the inefficiency of such state-run environmental protection areas for their leniency before. One example is the neighbouring Triunfo do Xingu, which has had <a href=\"https:\/\/www.researchgate.net\/publication\/384189734_The_ineffectiveness_of_the_Triunfo_do_Xingu_Environmental_Protection_Area_in_curbing_deforestation_in_the_Brazilian_Amazon\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">some of the highest deforestation rates<\/a> within the Brazilian Legal Amazon in recent years.<\/p>\n<p>Meanwhile, Funai restricted areas ban all outsiders. The latter offers critical protection for uncontacted peoples, whose <a href=\"https:\/\/www.documentcloud.org\/documents\/28068908-ituna-itata-pa\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">immunological vulnerability<\/a> means a single encounter with invaders could trigger a catastrophic health crisis.<\/p>\n<p>A federal court <a href=\"https:\/\/www.documentcloud.org\/documents\/28589920-10078495820264013903-2281745731-decisao\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">decision<\/a> on August 26 found that the APA reduces the level of protection for Ituna\/Itat\u00e1 established by the federal government and declared it unconstitutional. While it did not annul the state law, it ruled that the law cannot be used to alter the federal protection regime currently in force.<\/p>\n<p>The judge also said that the Union and Funai must send teams from the Public Security Force within 48 hours to contain the invasion. A daily fine of R$ 50,000 (around USD $9,627) was established in case of non-compliance.
