The court issued its decision on Jan. 21, 2026, and <a href=\"https:\/\/sc.judiciary.gov.ph\/sc-declares-24-7-monitoring-and-reporting-of-commercial-fishing-vessels-unconstitutional\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">announced<\/a> it publicly on Aug. 3, 2026.<\/p>\n<p>The Department of Agriculture\u2019s Bureau of Fisheries and Aquatic Resources (BFAR) filed a motion for reconsideration of the court\u2019s decision on Aug. 14.<\/p>\n<p>Without continuous tracking, fishers say authorities may<a href=\"https:\/\/news.mongabay.com\/2021\/07\/philippines-banks-on-new-fisheries-management-system-but-rollout-is-rocky\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"> struggle to detect commercial vessels entering municipal waters<\/a> \u2014 the coastal zone generally extending 15 kilometers (9 miles) from shore and reserved primarily for small-scale local fishers.<\/p>\n<p>\u201cIf some vessels could still enter municipal waters even when monitoring devices were installed, it could become even worse now that the Supreme Court has declared the requirement unconstitutional,\u201d Pablo Rosales, president of Pangisda Pilipinas, a national fisherfolk alliance, told Mongabay by phone.<\/p>\n<p>Some fishers and scientists also raised concerns that greater commercial fishing pressure could further reduce the number of fish available to coastal communities.<\/p>\n<figure id=\"attachment_326658\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/imgs.mongabay.com\/wp-content\/uploads\/sites\/20\/2026\/08\/19104646\/1-skipjack-purse-seine-fishery-2.jpg\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\"><img fetchpriority=\"high\" decoding=\"async\" class=\"size-full wp-image-326658\" src=\"https:\/\/imgs.mongabay.com\/wp-content\/uploads\/sites\/20\/2026\/08\/19104646\/1-skipjack-purse-seine-fishery-2.jpg\" alt=\"A skipjack purse seine fishery operation underway on the deck of a Philippine fish carrier\/supply boat. Image \u00a9 Alex Hofford \/ Greenpeace.<\/figcaption><\/figure>\n<h2><strong>T<\/strong><strong>racking commercial fishing<\/strong><\/h2>\n<p>FAO 266 formed part of Philippine regulations aimed at mitigating illegal, unreported and unregulated, or IUU, fishing.<\/p>\n<p>The European Union, an important Philippine seafood market, <a href=\"https:\/\/ec.europa.eu\/newsroom\/mare\/items\/16852\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">issued the country a \u201cyellow card\u201d in 2014<\/a> over shortcomings in addressing IUU fishing. In response, the Congress of the Philippines strengthened monitoring, control and surveillance under the Fisheries Code in 2015, after which the EU lifted the warning.<\/p>\n<p>BFAR introduced tracking in 2018 for commercial vessels targeting migratory stocks like tuna, mackerel, sardines and scad. FAO 266, which took effect in October 2020, expanded the requirement to all Philippine-flagged commercial fishing vessels.<\/p>\n<p>Onboard transceivers sent vessel positions, catches and other fisheries data to regulators, supporting enforcement, traceability, investigations and fisheries management. In a <a href=\"https:\/\/www.pna.gov.ph\/articles\/1280933\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">statement<\/a> reported by the state-run Philippine News Agency, BFAR called the system \u201ca frontline enforcement tool\u201d for monitoring vessels\u2019 adherence to regulations and conservation measures, including temporary fishery closures aimed at protecting spawning and nursery areas.<\/p>\n<p>The system was also intended to identify commercial vessels inside municipal waters, where local governments often lack patrol boats, personnel and fuel.<\/p>\n<p>Three commercial fishing companies challenged FAO 266 in December 2020. The Malabon Regional Trial Court declared it unconstitutional on June 1, 2021, and BFAR and the National Telecommunications Commission <a href=\"https:\/\/ncr.ntc.gov.ph\/wp-content\/uploads\/2022\/Announcements\/News_&amp;_Events\/MEMORANDUM-PERMANENT-%2520INJUNCTION-ON-THE-ISSUANCE-OF-MARITIME-MOBILE-SERVICE-%2520IDENTITY-(MMSI)-TO-FISHING-VESSELS-COVERED-BY-DA-FAR-FARO-266-SERIES-OF-2020.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">appealed<\/a> to the Supreme Court on June 25, 2021.<\/p>\n<p>BFAR suspended implementation in February 2022 while the appeal was pending. By then, 1,566 of 2,997 targeted vessels \u2014 about 52% \u2014 had <a href=\"https:\/\/www.rappler.com\/environment\/philippines-bets-fisherfolk-halts-policy-protecting-town-waters-big-fishers\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">received<\/a> government-provided transceivers. Image by Gary Todd via <a href=\"https:\/\/www.flickr.com\/photos\/101561334@N08\/52188309091\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">Flickr<\/a> (Public domain).<\/figcaption><\/figure>\n<p>Oceana Philippines, the local arm of international marine conservation NGO Oceana, runs <a href=\"http:\/\/www.karagatanpatrol.org\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">Karagatan Patrol<\/a>, a monitoring platform that uses VIIRS satellite data to detect high-radiance lights associated with commercial fishing vessels operating inside municipal waters.<\/p>\n<p>According to data compiled by the platform, detections rose to 44,924 in 2019, fell to 26,295 in 2022 during the COVID-19 pandemic, and totaled 27,351 in 2025.<\/p>\n<p>\u201cWhile there was a reduction in recent years, Karagatan Patrol data indicate a continuing apparent intrusion into municipal waters,\u201d Jessie Floren, Oceana\u2019s database administrator and the platform\u2019s developer, told Mongabay by email. He said detections remained elevated and reinforced the need for continued monitoring, enforcement and protection.<\/p>\n<h2><strong>W<\/strong><strong>hy the court rejected the rule<\/strong><\/h2>\n<p>The companies challenging FAO 266 argued that continuous tracking violated protections against unreasonable searches, exposed confidential fishing grounds and trade secrets, and unfairly applied only to commercial vessels.<\/p>\n<p>The Supreme Court ruled that FAO 266 failed the rational basis test, which assesses a regulation\u2019s constitutionality by asking whether it serves a legitimate state interest and is reasonably related to that goal.<\/p>\n<p>The court said the government had not sufficiently shown that the systems could detect IUU fishing beyond protected or restricted areas, while some data duplicated existing reports.<\/p>\n<p>It also found no express legal basis for round-the-clock tracking, recognized specialized fishing grounds as potentially proprietary, and ruled that excluding municipal vessels violated equal protection. It cited due-process defects because stakeholders were not adequately informed of the supporting study or given sufficient opportunity to nominate experts and comment.<\/p>\n<p>The court <a href=\"https:\/\/sc.judiciary.gov.ph\/sc-declares-24-7-monitoring-and-reporting-of-commercial-fishing-vessels-unconstitutional\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">acknowledged<\/a> that \u201ccombating illegal fishing and protecting the country\u2019s marine resources are legitimate and compelling State interests,\u201d but stressed that \u201cthese objectives cannot justify measures that unnecessarily infringe constitutional rights, particularly when the same goals may be achieved through lawful and less restrictive means.\u201d<\/p>\n<p>Senior Associate Justice Marvic Leonen <a href=\"https:\/\/sc.judiciary.gov.ph\/256282-256559-257049-dissenting-opinion-senior-associate-justice-marvic-m-v-f-leonen\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">dissented<\/a>, warning that invalidating FAO 266 created a \u201clegal void.\u201d He proposed allowing agencies to correct the regulation\u2019s defects.<\/p>\n<figure id=\"attachment_326653\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/imgs.mongabay.com\/wp-content\/uploads\/sites\/20\/2026\/08\/19104140\/27661864073_312c0e102f_k.jpg\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-326653\" src=\"https:\/\/imgs.mongabay.com\/wp-content\/uploads\/sites\/20\/2026\/08\/19104140\/27661864073_312c0e102f_k.jpg\" alt=\"Men and women from Pagudpud, Philippines, work as a team to haul in a net of tuna. Image by \u00a9 Alex Hofford \/ Greenpeace.<\/figcaption><\/figure>\n<h2><strong>C<\/strong><strong>ontinuing pressure on coastal waters<\/strong><\/h2>\n<p>Wilfredo Campos, a fisheries professor at the University of the Philippines Visayas, said many Philippine fishing grounds have been <a href=\"http:\/\/oneocean.org\/download\/db_files\/fshprofl.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">overfished since the 1980s<\/a>. A <a href=\"https:\/\/ph.oceana.org\/wp-content\/uploads\/sites\/16\/2026\/02\/Philippine-Fisheries-Assessment.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">2017 BFAR assessment<\/a> found that 88.6% of 166 fish stocks assessed nationwide were overfished.<\/p>\n<p><a href=\"https:\/\/www.researchgate.net\/publication\/357701139_Chapter_2_A_baseline_report_on_the_current_status_of_the_sardine_fishery_in_the_Republic_of_the_Philippines\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">Studies<\/a> by OceanBio Laboratory, co-founded by Campos, in three major fishing grounds found <a href=\"https:\/\/www.researchgate.net\/publication\/389720954_Developing_the_sardine_management_plan_for_Fisheries_Management_Area_7\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">declining sardine abundance and reproductive capacity<\/a>, with younger fish producing fewer, smaller eggs and fewer surviving larvae.<\/p>\n<p>\u201cIf current rates of fishing continue, stock abundance will continue to decrease,\u201d Campos told Mongabay by email.<\/p>\n<p>Campos said sardines, round scad (<em>Decapterus macrosoma<\/em>), short mackerel (<em>Rastrelliger brachysoma<\/em>) and tuna move between municipal and offshore waters, meaning commercial and small-scale fishers draw from the same stocks. In overexploited grounds, additional catch by one sector reduces what remains for the other. Commercial operations may harvest thousands or tens of thousands of kilograms during a single trip, compared with about 1-10 kg (2.2-22 pounds) per municipal operation, according to Campos.<\/p>\n<p>Rosales of Pangisda Pilipinas identified competition inside municipal waters as one factor behind declining catches. Under the <a href=\"https:\/\/sc.judiciary.gov.ph\/wp-content\/uploads\/2024\/01\/Internal-Rules-of-the-SC-8.29.17.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">Court\u2019s rules,<\/a> the motion may be filed within 15 days of receipt of the decision.<\/p>\n<p>\u201cWe are fairly confident the Supreme Court will reconsider the ruling,\u201d Philippine Agriculture Secretary Francisco Tiu Laurel Jr. said in a statement quoted <a href=\"https:\/\/www.pna.gov.ph\/articles\/1280933\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">by the Philippine News Agency<\/a>. He described vessel monitoring as an internationally recognized system that relies on electronic rather than manually filed data.<\/p>\n<p>BFAR said it would review its framework, adding that any future system would incorporate \u201cconstitutional safeguards.\u201d<\/p>\n<p>Campos said his laboratory\u2019s simulations for the Visayan Sea indicate that a 20% increase in commercial catches could leave 10,400 municipal fishers with no catch. Since the <a href=\"https:\/\/www.researchgate.net\/lab\/Oceanbio-Lab-Wilfredo-Campos\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external\">analysis<\/a> covered only one major fishing ground, Campos questioned whether authorities were prepared for similar pressures elsewhere in the country and how they would support the many artisanal fishing households that could be affected.<\/p>\n<p>\u201cWithout the VMS [vessel monitoring system], commercial fishing in municipal waters is likely to increase from current levels,\u201d Campos said. \u201cOur simulations provide an idea of how the scenario would look.\u201d<\/p>\n<p><em><strong>Banner image:<\/strong> A worker lifts a tuna after it has been weighed at a fish market.
